Italy Fines Apple €98.6 Million Over ATT Rules Limiting App Store Competition

The Italian antitrust authorities found that Apple’s App Tracking Transparency (ATT) privacy framework hindered competition in the App Store and fined the corporation €98.6 million ($116 million).

The company’s “absolute dominant position” in app distribution, according to the Italian Competition Authority (Autorità Garante della Concorrenza e del Mercato, or AGCM), permitted it to “unilaterally impose” the ATT requirements on third-party app developers without first consulting them. In May 2023, the investigation was started.

The AGCM claimed that it is criticizing the consent rules, which are “disproportionate” to ATT’s declared goals and too demanding for developers, rather than questioning Apple’s decision to implement measures intended to improve consumers’ privacy on iOS.
